Inheritance with Debts: Accepting under Benefit of Inventory

Inheriting can also mean inheriting debts. Benefit of inventory protects you: you only answer with what you inherit, not with your own assets.

Inheritance · Updated January 2026 · 6 min read

Accepting an inheritance means receiving not only assets but also the deceased's debts. If you accept purely and simply, you answer for those debts even with your personal assets. There are safer alternatives.

The three options

  • Pure and simple acceptance: you inherit everything, but answer for the debts without limit.
  • Acceptance under benefit of inventory: you only answer for the debts up to the value of what you inherit; your own assets are safe.
  • Renunciation: you inherit nothing (neither assets nor debts).

Benefit of inventory

It requires drawing up an inventory of assets and debts before a notary and meeting strict deadlines. It is the prudent option when it is unclear whether the estate is solvent. In Catalonia, succession is governed by its own civil law.

Before deciding

It is worth knowing the real assets and liabilities (charges on the home, loans, guarantees). We help you weigh the best option and meet the deadlines.
