The deposit is a mandatory amount the tenant hands over on signing the lease as a guarantee. In Catalonia it has a particularity: it must be lodged with INCASÒL.

  • Primary home: one month's rent.
  • Other uses (seasonal, commercial): two months.

Mandatory lodging in INCASÒL

The landlord must lodge the deposit with the Catalan Land Institute (INCASÒL) within the legal period. Failing to do so can lead to penalties and problems.

Additional guarantees and return

  • Besides the legal deposit, additional guarantees can be agreed within the LAU limits.
  • At the end, the deposit is returned to the tenant except for damage (beyond normal wear) or unpaid rent.
